General Terms and Conditions (GTC)

1. Scope

These General Terms and Conditions (GTC) apply to all orders placed by consumers (hereinafter "customer" or "you") via the webshop of ZeaLite GmbH, Quellenstrasse 40D, 5242 Birr, Switzerland (hereinafter "ZeaLite").

Sales are made exclusively to private end consumers (B2C).
Deliveries are possible to Switzerland, Germany and other EU countries (see point 6).

By placing an order you agree to these terms and conditions.

3. Conclusion of contract

The products presented in the online shop do not constitute a binding offer. The contract is concluded upon completion of the order process and sending of the automatic order confirmation by email.

ZeaLite reserves the right to refuse orders without giving reasons, particularly in cases of suspected commercial use, misuse, or delivery difficulties.

4. Products and restrictions on use

ZeaLite sells physical, organic-based products, including:

  • Bioluminescent algae in decorative containers (“GlowBottle” etc.)

  • Chlorella vulgaris in photobioreactors for air purification (“AlgaeTower” etc.)

  • Digital gift vouchers

The microalgae supplied are living organisms and subject to natural fluctuations. The products are intended for private use.

Commercial use prohibited:

Commercial use, cultivation, reproduction, or resale of the live algae is expressly prohibited. Violations entitle ZeaLite to assert civil and criminal claims.

5. Prices and payment methods

All prices are in Swiss francs (CHF) or – for deliveries to Germany and the EU – in euros (EUR), including statutory VAT, unless otherwise stated.

Payment options:

  • TWINT

  • PayPal

  • Apple Pay / Google Pay

  • Instant bank transfer (Klarna)

Payment is made via Shopify Payments.

6. Delivery and shipping

Delivery area:

  • Switzerland

  • Germany

  • Other EU countries on request / after technical activation

Shipping service provider:

  • Swiss Post (PostPac Priority) for domestic mail

  • Swiss Post GLS for Germany

Shipping costs:

Switzerland (PostPac Priority):

  • Package up to 2 kg: CHF 10.50

  • Parcel up to 10 kg: CHF 13.50

  • For orders over CHF 100: free shipping

Germany (Swiss Post GLS):

  • Parcel up to 2 kg: CHF 33.90 → You pay only CHF 16.95

  • Parcel up to 5 kg: CHF 36.00 → You pay only CHF 18.00
    (ZeaLite covers 50% of the shipping costs)

The exact shipping costs are displayed transparently during checkout.

Delivery time:

  • Switzerland: approx. 1–2 working days

  • Germany: approx. 2–3 working days

  • EU countries: approx. 4–8 working days (if activated)

Shipping of living products:

Live microalgae are shipped with the utmost care. ZeaLite reserves the right to postpone shipment in cases of extreme temperatures (e.g., >30°C).

The transport risk for live products is transferred to the customer upon handover to the shipping service provider. We recommend accepting the delivery as soon as possible and storing it correctly.

Should the container (GlowBottle or AlgaeTower) break during transport, we will send a replacement free of charge. Please provide a photo of the damage by email to contact@zealite.com within 3 days of delivery.

The transport risk for live products is transferred to the customer upon handover to the shipping service provider. We recommend accepting the delivery as soon as possible and storing it correctly.

7. Retention of title

The goods remain the property of ZeaLite GmbH until full payment is received. Use is permitted exclusively for non-commercial, private purposes.

8. Cancellation and return

Voluntary right of return (Switzerland and Germany)

ZeaLite voluntarily grants a return option within 14 days of receipt of the goods – for customers in both Switzerland and the EU. This is not a full right of return, but rather a goodwill gesture:

For products that do not work as intended – for example:

  • no luminous effect (GlowBottle)

  • visible contamination or turbidity

A partial refund of up to 50% or a free replacement of the algae can be granted.

For customers in Germany: According to Section 312g Paragraph 2 No. 2 of the German Civil Code (BGB), there is no right of withdrawal for perishable products, especially live algae and seawater nutrient solutions. However, there is a right of withdrawal for the GlowBottle container itself – therefore, in the event of a withdrawal, a partial refund of up to 50% can be issued.

A report with a photo must be sent to contact@zealite.com within 14 days of receipt.

No returns for:

  • gross mistreatment or improper care

  • Use of unsuitable liquids (e.g. tap water)

  • Damage caused by extreme temperatures or improper storage

9. Warranty and Defects

ZeaLite offers a voluntary 14-day guarantee on the biological function of its living products, provided they are used properly according to the instructions.

Excluded from the guarantee:

  • Damage caused by improper storage (e.g. lack of light, heat, cold)

  • natural aging / dimming of luminosity

  • Use of unsuitable nutrient solution or tap water

  • Glass breakage or mechanical damage

Complaints must be documented with relevant photos and reported within the warranty period.

10. Customer account and data protection

Opening a customer account is optional. Personal data is processed in accordance with Swiss data protection legislation (DSG) and – for EU customers – additionally in accordance with the EU General Data Protection Regulation (GDPR).

11. Intellectual Property

All content on www.zealite.com (text, images, designs, trademarks) is the property of ZeaLite GmbH or its licensors. Any use beyond private purposes requires written permission.

12. Severability Clause

ZeaLite reserves the right to change these Terms and Conditions at any time. The version valid at the time of the order applies.
Should individual provisions of these Terms and Conditions be or become invalid in whole or in part, the validity of the remaining provisions shall remain unaffected.

13. Applicable law and place of jurisdiction

Swiss substantive law shall apply exclusively, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

For customers residing in Switzerland or the EU:
The place of jurisdiction is the registered office of ZeaLite GmbH in 5242 Birr, Switzerland.

Product safety and use

The algae contained in our products are non-toxic and harmless to humans. However, they are grown in a seawater or freshwater culture medium that is not suitable for consumption. Furthermore, the culture is not sterile. Therefore, the possibility of other microorganisms being present cannot be ruled out.

The products are intended for observation purposes only. We assume no liability for any damage or health consequences resulting from drinking, ingesting, or other improper use. We expressly and strictly advise against consumption.

Digital vouchers

Digital vouchers are sent via email as PDFs and are valid for 5 years from the date of delivery. Cash payment is not possible.
